IF YOU DO NOT AGREE WITH THESE TERMS OF USE YOU ARE NOT PERMITTED TO ACCESS OR USE THIS SITE NOR CONTRACT OUR SERVICES. ADDITIONALLY, IF YOU ARE UNDER 18, YOU MUST NOT CONTRACT OUR SERVICES.
This site, app, or a WhatsApp account is supplied by USMoneyUp, Inc. (“MoneyUp,” “we,” “us,” or “our”) (each such page, app or WhatsApp account, being a “MoneyUp Site” or “Site”). These terms of use (“Terms”) apply to your access and use of the services offered on or through the Site (“Services”) or any instrument or other communication channel belonging to MoneyUp. “You”, “your” and “User” refer to any person who accesses or uses the Services (or, if you are accessing or using this site as a representative on behalf of a legal entity, then those terms refer to you and that entity, collectively). The Services are intended for people who are at least 18 years old. If you are under the age of 18, you are prohibited from using the Services.
MoneyUp reserves the right to modify these Terms at any time without prior notice to you by posting a new version to the Site. Any change to these Terms will be effective immediately when the updated Terms are posted on the Site. You can find the current version of the Terms at any time by clicking the “Terms of Use” or “Legal” link at the Site. By continuing to access the Site or use the Services on or after the date new Terms are posted, you agree to be bound by the most recent version of these Terms.
Contracting our Services: Unless otherwise specified by MoneyUp, our Services are offered by communication messages through WhatsApp and subject to these Terms. Your acceptance of these Terms and use of our Services is done through WhatsApp or such other means as we may make available. You can’t use MoneyUp if you do not have a WhatsApp account. WhatsApp offers end-to-end encryption for our Services. End-to-end encryption means that your messages are encrypted to protect against third parties from reading them. To use some or all the Services, you must first register your WhatsApp account with MoneyUp link and provide us with certain information. You promise that all information you provide during the registration process or at any later time must be complete, accurate, and truthful. It is your responsibility to keep your contact information on file with us updated. We may, for any reason or for no reason, refuse to provide or discontinue providing services to any person or entity at any time and without prior notice or consent. What information we collect, what we do with it and how we disclose it are discussed below under the ‘Privacy’ section below and in our privacy policy available here usmoneyup.com/privacy-policy (“Privacy Policy”).
All of your transactions and engagements with us are through your WhatsApp account. We will treat instructions received from your WhatsApp account as if they are your instructions. We will also send information to you through your WhatsApp account. You can use the Services only to conduct transactions on your own account and not on behalf of any other person or entity. You may only register with MoneyUp once. This means you can’t contract MoneyUp’ services using two distinct WhatsApp accounts. If we detect duplicate WhatsApp accounts for a single user, on WhatsApp notice to you MoneyUp may close or merge these duplicate accounts without prior consent.
1. User Security
You, not MoneyUp, are responsible for maintaining the proper security and control of all identifiers, passwords, or any other details you use to access your WhatsApp account and services. You should never disclose your WhatsApp account password. Keep them secure and change them regularly. We will never ask you to provide your password to us or any third party. Never allow anyone to access your WhatsApp account or watch you while accessing it. If you suspect someone unauthorized has access your WhatsApp account or to your login credentials, please inform us immediately at customersupport@usmoneyup.com or 702-329-0136 for us to proceed with the blocking of your access to our services. Compromising your credentials could allow thieves to access MoneyUp and attempt unauthorized transactions. Additionally, contact us immediately if your MoneyUp transaction history shows unauthorized transactions. We rely on you to regularly supervise your transaction history and contact us immediately if you have any questions or concerns.
To help prevent fraud, only use payment links received from our verified WhatsApp business account and ensure their authenticity before proceeding. Never share personal information, such as security codes, over WhatsApp, and report any suspicious links or messages to our support team immediately. We are not liable for any losses resulting from unauthorized transactions due to unverified or fraudulent links. Your vigilance is essential in maintaining a secure payment environment.
IT IS POSSIBLE THAT BAD ACTORS WILL CREATE FAKE ACCOUNTS THAT LOOK LIKE A MONEYUP ACCOUNT. IF YOU HAVE ANY DOUBTS, PLEASE VERIFY THAT THE ACCOUNT IS GENIUNE BY CONTACTING US AT customersupport@usmoneyup.com or 702-329-0136.
2. MoneyUp Services
MoneyUp works with merchants (each, a “Merchant”) that sell vouchers (each, a “Voucher”). When you buy a Voucher from a Merchant, the Voucher is redeemable by you for products or services of the Merchant. Each Voucher and can only be redeemed for products or services provided by a single Merchant and not for cash or cash equivalents. Vouchers are single-use and non-reloadable. Unless otherwise expressly agreed by you, us and the Merchant, as soon as you buy a Voucher, MoneyUp will instruct the Merchant issuing the Voucher to redeem it for you against the Merchant invoice (“Invoice”) that you have selected to pay using the Voucher. If the Voucher is not redeemed or the Merchant fails to apply the Voucher amount as directed, you will look to the Merchant for recovery and not to MoneyUp. MoneyUp is not the issuer of the Voucher and other than helping the Merchant sell it to you and making it available to you, MoneyUp has no responsibility with respect to the Voucher. The Merchant is the solely responsible for any liability arising from Vouchers. MoneyUp does not hold on its books any deposit, stored value, prepaid access, other credit or voucher belonging to a User for future use. All total or partially unredeemed Voucher amounts are held by the respective Merchant for you on their own balance sheet. Neither your account in MoneyUp’ system nor the Vouchers owned by the User are bank accounts, stored value or another form of negotiable instrument or financial account. MoneyUp is not a bank and does not offer banking services.
Vouchers are priced in and sold for US Dollars. Please note that prices for Vouchers and applicable fees may change from time to time without prior notice. The price you will pay is the price indicated on the Site when you place your order. Please place and complete orders carefully.

Please include your voucher number and WhatsApp account number in all communications for prompt service.
3. Merchant-Specific Terms & Conditions
When you buy a Voucher from a Merchant through the Site, the Voucher is subject to the Merchants’ terms and conditions concerning the redemption of Vouchers (“Merchant Terms”). Merchant Terms will be presented to you for acceptance before you buy a Voucher. It is important to read them thoroughly before purchasing the Voucher. If you decide to complete the purchase of a Voucher, you agree that these Terms and the Merchant Terms will both apply to you. If there is a conflict between these Terms and Merchant Terms, the Merchant Terms will prevail.
4. Purchase Limits
Maximum daily and monthly purchases
An individual User cannot buy more than TWO THOUSAND U.S. DOLLARS ($2,000) of Vouchers PER DAY and cannot spend more than TEN THOUSAND U.S. DOLLARS (US$10,000.00) on Vouchers per calendar month.
Maximum Merchant Users / Beneficiaries
When you buy a Voucher, you are allowed to give it as a gift to a single close family relative or friend who is located in the same jurisdiction where the Merchant is located (each, a “Merchant User”). You cannot share your Vouchers with more than eight (8) Merchant Users in a single calendar month. If you share information concerning your Merchant User with us (e.g. your relative’s phone number and Merchant service account number), you agree that the Merchant User has given you permission to share that information with us. You allow us to share your Voucher information with the Merchant Users that you identify.
5. Automatic Redemption
Unless otherwise expressly agreed by MoneyUp and you, when you purchase a Voucher for a specific amount from a specific Merchant and if you or a Merchant User of yours has an outstanding Invoice for a matching amount, you direct MoneyUp to instruct the Merchant to automatically redeem the Voucher against the outstanding Invoice, without additional approvals from you. Merchant has appointed MoneyUp as its agent to receive Voucher purchase price amounts on behalf of the Merchant; when you make a payment to the Merchant through the Site, it is deemed to be received by the Merchant as soon as the amount is settled to MoneyUp.
If a purchase exceeds the voucher value: If the Merchant is owed amounts more than the Voucher value, the balance can be paid using an acceptable payment method directly with the Merchant, but not through MoneyUp. Unused Voucher balances are subject to Merchant Terms and are not MoneyUp’s responsibility.
Merchant Customer Service: After you use a Voucher to pay an Invoice, if you wish to exchange or file a complaint about any Merchant product or service, your rights concerning such matters are governed under Merchant Terms and laws applicable to the Merchant and yourself or your Merchant User. No cash refunds are provided for Voucher values; exchanges can only be made for goods or store credits.
Voucher Cancellation: Neither you nor a Merchant User can redeem a Voucher for money or anything that substitutes for money. A Voucher may only be cancelled if it was not partially or totally redeemed or void. At the discretion of Merchant or MoneyUp, a Voucher may be cancelled in which case you will be refunded the purchase price. Such refunds will not be settled to Merchant Users or third parties – only to the person who paid for the Voucher and only through the payment method used (e.g. card or ACH). If the payment instrument used to pay for the Voucher is not available by the time of the return, MoneyUp, on an exceptional basis and subject to requiring additional information from you, may return the funds to a different instrument only and after confirming that the beneficiary and User are the same person.
6. Fees
By using our Service, you acknowledge that MoneyUp provides an innovative, convenient way to purchase Vouchers. MoneyUp’s Services are optional and designed for those who prefer the simplicity and speed of online transactions over traditional payment methods for Merchant Vouchers. Although Merchants may offer other payment options, such as mail-in or in-person payments, a convenience fee applies to each Voucher purchased through our Service. This fee covers: (i) the privilege of paying for the Voucher using an alternative payment method that is not standard for Merchants; and (ii) the provision of secure and efficient payment and delivery method for your Vouchers. All applicable convenience fees will be disclosed before you accept each transaction. Convenience fees are charged by MoneyUp and they are in addition to the cost of the Voucher charged by the Merchant.
7. 30-Minute Cancellation and Refund Policy
You have the right to cancel any Voucher purchase transaction within 30 minutes of completion. Should you choose to cancel within this window, you will receive a full refund, including any applicable convenience fees and Voucher purchase price. To initiate a cancellation, please contact our support team through the information below within the 30-minute period. After this timeframe, transactions are considered final, and cancellation or refund may not be guaranteed.
8. REFUND & RETURN POLICY
EXCEPT AS PROVIDED ABOVE, ALL VOUCHER SALES ARE FINAL. MONEYUP OFFERS NO RETURNS, REFUNDS OR EXCHANGES OF ITS VOUCHERS SOLD YOU. VOUCHERS ARE REDEEMABLE AT A SPECIFIC MERCHANT FOR ONLY ITS GOODS OR SERVICES AND NOT FOR CASH OR CASH EQUIVALENTS. MERCHANTS WILL NOT REDEEM VOUCHERS FOR CASH OR CASH EQUIVALENTS. The Merchant Terms sets out the Merchant’s refund and return policy.
Voucher Void: If you receive a Voucher for which you have not paid or for which your payment was insufficient, reversed, refunded or charged back, MoneyUp will instruct the Merchant to void the Voucher in question in order to prevent potential fraud by the User
Voucher Transfer: Voucher codes may not be transferred as part of a financial negotiation with a third party. The code is redeemable by the bearer which must be you or a single Merchant User selected by you who is a family member or friend of yours.
9. Right to Void in Suspicious Transactions
You cannot use Vouchers to operate a money transfer service, as means of transferring value from one person to another person or for any purpose that is illegal in the United States or in the jurisdiction where Merchant or a Merchant User is located. You are prohibited from purchasing a Voucher if you are a Specially Designated National as defined by the U.S. Department of the Treasury Office of Foreign Assets Control or are otherwise subject to U.S. sanctions. MoneyUp reserves the right to void, deactivate, or reject Vouchers if they are suspected to be sent or redeemed fraudulently or in violation of our terms.
10. Promotional communications
You agree to receive promotional content and promotional communications from MoneyUp via email and other electronic means of communication, including short message services (SMS) or WhatsApp message. The User may, at any time, opt-out of receiving promotional communications by replying with any of the following keywords “stop”, “unsubscribe”, “cancel”, “end”, or “quit” to the phone number from which the User is receiving the promotional communications. This action will place the user’s account on MoneyUp’s block list and prevent the user from receiving further promotional communications. Please note that if you opt out of receiving promotional communications, we may still send you electronic communications regarding factual, transactional and/or service information in connection with your user account and the services we offer. If you have any questions about our use of your personal information, please contact us at customersupport@usmoneyup.com.
11. Service Payment
When you buy a Voucher, you agree that MoneyUp can charge your credit or debit card or to proceed with the electronic direct payment request via ACH (or any other similar way to transfer funds) to transfer funds from the payment account you have supplied to MoneyUp’s account (each such payment method, a “Payment Instrument”) for the purpose of making the payment. By registering a Payment Instrument, you represent and warrant to MoneyUp that you are an authorized user of such Payment Instrument. You may change the Payment Instrument associated with your User at any time. You are responsible for ensuring that the Payment Instrument utilized is non-expired and valid for payments.
YOU AGREE THAT WE ARE NOT, UNDER ANY CIRCUMSTANCE, LIABLE, EITHER DIRECTLY OR INDIRECTLY, FOR THE PRODUCTS OR SERVICES PROVIDED OR SOLD BY ANY MERCHANT FROM WHOM YOU PURCHASED A VOUCHER THROUGH OUR SITE. PRODUCTS AND SERVICES SUPPLED BY AND INFORMATION AND CONTENT PUBLISHED BY THE MERCHANT ARE THE SOLE AND EXCLUSIVE RESPONSIBILITY OF THE MERCHANT. WE ARE NOT RESPONSIBLE FOR AND DO NOT OFFER ANY WARRANTY REGARDING THE QUALITY, ACCURACY, TIMELINESS, RELIABILITY OR ANY OTHER ASPECTS OF PRODUCTS OR SERVICES FROM MERCHANTS. YOU RELEASE US FROM ANY DAMAGES OR LOSS THAT YOU MAY INCUR, AND AGREE NOT TO ASSERT ANY CLAIMS AGAINST US, ARISING OUT OF YOUR USE OF OR RELIANCE ON PRODUCTS, CONTENT OR SERVICES FROM MERCHANTS.
12. LIMITATION OF LIABILITY
EXCEPT WHERE PROHIBITED BY LAW, MONEYUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS. EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT SHALL MONEYUP'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO MONEYUP FOR VOUCHERS IN THE THIRTY (30) DAYS PRIOR TO THE CLAIM ARISING, OR AS OTHERWISE REQUIRED BY APPLICABLE LAW.
13. Copyright, Trademarks and License of Use
MoneyUp reserve all right, title and interest in and to any content on the Site and all intellectual property rights therein. The Site and all content and other materials on the Site, including, without limitation, our logo and all designs, text, graphics, images, information, data, software, sound files, other files and the selection and arrangement thereof (collectively, the “Site Materials”) are the property of MoneyUp or its licensors. No right or license to the Site Materials is granted under these Terms. Nothing can be copied, in whole or in part, without the prior written permission of MoneyUp or the applicable trademark owner. All rights not expressly granted are reserved. The User may not copy or remove any of the trademarks or logos included in the Site accessed or used from the Site. Any use of the Site other than for personal use is prohibited, including, without limitation, resale, transfer, modification or distribution of the Site or the text, images, music, bar codes, video, data, hyperlinks, displays and other content associated with the Site. Unless MoneyUp gives its prior written consent, the User may not make any commercial use of the Site or its content, nor distribute, store, publish, copy, reproduce or publicly display any of the content or materials on the Site.
14. Privacy
MoneyUp’s Privacy Policy forms part of these Terms. Please read our Privacy Policy to understand how MoneyUp collects, uses and discloses personally identifiable information about its users. By accessing or using the Site, you consent to all actions MoneyUp takes with respect to your data in accordance with our Policy.
Feedback: You agree that all Feedback is, and will be treated as, non-confidential and non-proprietary, except as otherwise specifically agreed or required by law. Except as prohibited by applicable law, you grant to MoneyUp a non-exclusive, royalty-free, worldwide, perpetual license, with the right to sub-license, to use, reproduce, distribute, transmit, create derivative works of, publicly display and publicly perform any materials and other information (including, without limitation, ideas contained therein for new or improved products and services) you submit to any public areas of the Site (such as bulletin boards, forums and newsgroups) or by e-mail to MoneyUp by all means and in any media now known or hereafter developed. Where this assignment is prohibited by law, you grant MoneyUp an exclusive, transferable, worldwide, royalty-free, fully paid up license (including the right to sublicense) to use and exploit all Feedback as we may determine in our sole discretion. Such Feedback may include ideas for new or improved products or services, concepts, know-how, techniques, and the like. You understand and agree that MoneyUp is not obligated to use, display, reproduce, or distribute any such ideas, know-how, concepts, or techniques contained in the Feedback, and you have no right to compel such use, display, reproduction, or distribution.
Chat: MoneyUp may use an interactive online chat service when communicating with you, including, but not limited to, when providing customer service. MoneyUp makes no warranty that the Chat service will be available at any particular time or be free of fault or error. We will disclose the use of the Chatbot to the extent required by applicable law. When engaging with us through use of the Chat service, be advised that chats may be monitored and retained. Any personal information shared with us when using the Chat service shall be subject to our applicable Privacy Policy.
15. Suspension or discontinuance of the Site
MoneyUp reserves the right to modify or discontinue, temporarily or permanently, the Site, the Services or any feature or part thereof without notice. The User agrees that MoneyUp shall not be liable for any modification, suspension or discontinuance of the Site or any part thereof. No termination or modification of MoneyUp Services will diminish the value of Vouchers you have purchased and not yet redeemed.
Termination of Access. We may, in our sole discretion, terminate or suspend your entry to and/or use of, any or all MoneyUp Sites and Services, at any time, with or without notice and for any reason or no reason on WhatsApp notice to you. You agree that if we terminate your access to the Services, you will not: attempt, directly or indirectly, to enter, use and/or access the Site, Services, or your account until such suspension is lifted. We also reserve the right to cancel accounts that have been inactive for six months.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware.
17. Dispute Resolution and Arbitration Agreement
Any dispute, claim, or controversy arising out of or relating to the services provided by MoneyUp or these Terms, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Wilmington, Delaware before one arbitrator. The arbitration shall be administered by the American Arbitration Association (AAA) pursuant to its Consumer Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. If for any reason, AAA is unable or unwilling to conduct the arbitration, the parties may agree to select an alternative ADR provider. The parties agree that the arbitration shall be conducted in the English language and that the AAA’s online arbitration platform can be used if both parties agree.
Notwithstanding any other provision in these Terms, the parties agree that any claims brought under these Terms or in connection with the Services shall be brought in the individual capacity of the party bringing the claim, and not as a plaintiff or class member in any purported class or representative proceeding. The parties expressly waive any right to file or participate in a class action or seek relief on a class basis in any jurisdiction or forum.
18. Severability
If any provision of these Terms shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
19. General
These Terms constitute the entire agreement between the User and MoneyUp governing the User’s access to and use of the Site and supersede any prior agreements between MoneyUp and the User relating to the Site or its content. The User may not transfer or assign any of its rights under these Terms.
20. Complaints and Error Resolution
Please be aware that MoneyUp does not process complaints or inquiries regarding service-related matters of the Merchant, such as service issues, status inquiries, tax information requests, or recipient-requested changes. If you experience any errors specifically related to transactions processed through MoneyUp, you must direct those inquiries to us. All questions about Voucher purchases initiated through our Services should be directed to MoneyUp’s customer support.
Under an agreement with the Merchant, MoneyUp provides payment processing and digital platform services to Merchants, and we will work with the Merchant as necessary to investigate and resolve any errors related to Voucher sales and payments.
If you believe an error has occurred with your transaction, promptly contact our customer support team through the information below with your transaction details and a description of the suspected error. MoneyUp will begin investigating the issue upon receipt of your request. Our resolution process typically involves responding to you within 10 business days. If it takes more than 10 days MoneyUp will complete its review within 45 days but provisionally credit your account at the end of the first 10 days.
We will notify you of the results upon completion of our investigation and make any necessary adjustments to the transaction to correct any identified errors.
